“Your charges can differ depending on the results of the chemical test. However, a law enforcement officer declaring that you are in an intoxicated or impaired state can already be enough cause for you to be charged with an impaired driving offense,” the Long Island DWI/DUI attorney says.
The lawyer explains that in New York, a person may be guilty of driving while ability impaired (DWAI) if they are caught driving or operating a motor vehicle while having a BAC of more than 0.05% but less than 0.07%. They may also face a DWAI charge if the officer declares that their driving ability is impaired.
Attorney Jason Bassett says that for a DWI, a person may be charged if they test for a BAC of 0.08 or more, or if the officer declared the person to be in an “intoxicated condition”. Commercial drivers are not allowed to operate a vehicle if their BAC is more than 0.04, and those under 21 years of age should not operate a vehicle with a BAC of more than 0.02%.

They may also face the same charge if the effects of alcohol and controlled substance or the combination of the controlled substances are proven to have hindered or impaired their ability to drive judiciously.”
